Electronic commerce: Towards the end of dysfunctions in delivery in Morocco?

E-commerce turnover in Morocco reached 22 billion dirhams in 2023

A legal framework in place to protect consumers
The minister stressed that electronic commerce is governed by a series of laws aimed at guaranteeing the security of consumers and transactions. Among these are the Consumer Protection Code, laws relating to the security of goods and services, the use of electronic payments, the protection of personal data, as well as cybersecurity. These measures ensure consumers the right to take legal action in the event of a defect or problem related to the products purchased.

New mechanisms to regulate online platforms
Ryad Mezzour also announced the upcoming entry into force of new legislation aimed at identifying the operators of electronic platforms, which will strengthen transparency and hold stakeholders in this booming sector accountable.

The Post Office’s monopoly on light parcels at the heart of the debates
The minister addressed a major sticking point in e-commerce logistics: Barid Al-Maghrib’s historic monopoly on the delivery of packages weighing one kilogram or less. Under a decree dating from 1924, this monopoly limits the options of Moroccan companies specializing in distribution.

To get around this constraint, some companies would resort to unusual practices, such as the symbolic addition of a kilogram of salt to packages, a trick allowing them to escape the restrictions imposed by law.

A call to modernize the regulatory framework
This situation illustrates the urgency of modernizing an outdated legislative framework in order to promote fair competition and boost the e-commerce ecosystem. The government seems determined to resolve this problem in 2025, as part of a global reform of the sector.

With sustained growth in this market and high consumer expectations, Morocco is positioning itself to eliminate the obstacles hindering its development and strengthen confidence in digital commerce.
